Fee practices: the three-year term

Merchant One does not publish its full pricing. Its advertised rates have carried a qualifier that they apply to qualifying transactions, with full rates and fees in the merchant agreement. That agreement, according to reviewers and complainants, includes:
- A three-year initial term, set out in Merchant One’s program guide.
- An early termination fee reported as the greater of $295 or $25 for each remaining month, which can reach about $875. Complainants describe cancellation debits of $450, $750 and $900.
- Annual fees per location, reported at around $99.
- PCI non-compliance fees, including from merchants who say they completed their quarterly scans.
- Program and membership-style fees that merchants say they did not know they had agreed to.
Our read. The rate is rarely the problem in these complaints. The term, the exit fee and the small recurring charges are. Those are written into the agreement, so they are enforceable, but enforceable is not the same as explained. See how a merchant can have the lowest rate and the worst deal.
Complaints: a consistent story
Merchant One’s review profile splits sharply. Its Trustpilot average is high. Its Better Business Bureau review average is very low, reported at between about 1 and 2 stars, and its BBB complaints are steady into 2026.
The complaints are remarkably consistent. Merchants describe a sales conversation focused on a low percentage rate, followed later by a three-year contract they say was never mentioned, an early termination fee when they try to leave, and recurring fees they did not recognize. Recent complaints also describe deposits held after cancellation and difficulty getting a full accounting of fees. The company responds to BBB complaints, and some are resolved, but the pattern repeats.
Regulatory and legal: nothing found
We found no Federal Trade Commission or state attorney general actions and no class actions against Merchant One, and independent reviewers report the same. That earns most of the available points. We hold back three because a consistent complaint pattern about undisclosed contract terms is exactly the kind of conduct regulators have pursued against other sales organizations.
Transparency and sales channel
Merchant One’s own marketing has at times advertised no early termination fee and freedom to cancel, while its program guide sets a three-year term. Independent reviewers have flagged that gap repeatedly. Combined with a sales channel that complainants say focused on the rate and left out the term, it costs most of the available points in both categories.
